This Digital Product Licence explains how digital products purchased from The Wild Reverence Shop may and may not be used.

The Wild Reverence Shop is operated by Tayla Evans under the Wild Reverence name and brand.

By purchasing, downloading or using a digital product from The Wild Reverence Shop, you agree to the terms of this licence.

This licence should be read together with our Shop Terms & Conditions, Refund and Returns Policy and Privacy Policy.

About This Licence

When you purchase a digital product from The Wild Reverence Shop, you are purchasing permission to use that product in accordance with this licence.

You are not purchasing the copyright or ownership of the underlying photograph, artwork, design or other intellectual property.

Unless expressly stated otherwise on a product page, all digital products purchased from The Wild Reverence Shop are supplied under a personal-use licence.

The licence granted to you is personal, non-exclusive, non-transferable and non-sublicensable.

Digital Photography

Digital photographs purchased from The Wild Reverence Shop are supplied as digital files in the format and resolution described on the relevant product page.

Images displayed on the Wild Reverence website may be resized, compressed and/or watermarked for online preview purposes.

Where a product is described as including a high-resolution, unwatermarked photograph, the purchased file will be supplied without the Wild Reverence preview watermark.

The removal of a preview watermark from a purchased file does not remove or transfer the copyright or intellectual property rights associated with that photograph.

What You May Do

Unless otherwise stated on the relevant product page, you may use a purchased digital product for your own personal, non-commercial purposes.

For digital photographs, this includes permission to:

• download and store the purchased file on your personal devices;
• create reasonable personal backup copies of the file;
• display the photograph on your personal devices;
• use the photograph as a personal desktop, phone or tablet background;
• print the photograph for your own personal use;
• display a personally printed copy in your home or other private space;
• have a third-party printing service produce a print for your personal use; and
• give a physical print made from the photograph as a personal, non-commercial gift.

Any third-party printing service used to produce a personal print should receive the digital file only for the purpose of fulfilling that print order.

The digital file itself may not be transferred to another person as a gift.

Personal Social Media Use

You may share a reasonable representation of a purchased photograph on a personal, non-commercial social media account, provided that:

• the photograph is not offered for sale or redistribution;
• the original downloadable file is not made publicly available;
• the use is not connected to a business, brand, commercial service, paid promotion or other commercial activity;
• the photograph is not presented as your own photography or creative work; and
• where reasonably practical, Wild Reverence is credited as the creator.

For example, you may share an image of a Wild Reverence photograph printed and displayed in your home.

This permission does not allow you to upload the original high-resolution purchased file in a manner that enables other people to obtain or reproduce it.

What You May Not Do

Unless you have received prior written permission or a separate licence from Wild Reverence, you may not:

• sell or resell a purchased digital product;
• redistribute or share the original digital file with another person;
• upload the original file to a file-sharing platform, public drive, marketplace or similar service;
• sublicense, rent, lend or otherwise transfer the digital product;
• make the digital product available for others to download;
• sell prints made from the photograph;
• use the photograph on products or merchandise offered for sale;
• use the photograph in advertising, marketing or promotional material;
• use the photograph on a business or commercial website;
• use the photograph on a commercial social media account;
• use the photograph as part of paid or sponsored content;
• use the photograph as branding, a logo or trademark;
• submit the photograph to a stock photography or stock media platform;
• include the photograph in another digital product, template, design asset or downloadable resource;
• claim authorship or ownership of the photograph;
• register or attempt to register copyright, trademark or other intellectual property rights in the photograph;
• remove copyright information for the purpose of misrepresenting the origin or ownership of the work; or
• otherwise commercially exploit the digital product.

Editing and Alterations

You may make reasonable alterations to a purchased photograph where necessary for your permitted personal use.

For example, you may crop or resize a photograph to fit a personal device screen or a particular print size.

However, altering a photograph does not create a new work that you may sell, redistribute or claim as your own.

You may not materially alter, manipulate or incorporate the photograph into another work for commercial use without prior written permission from Wild Reverence.

Printing

You may print purchased digital photographs for your own personal, non-commercial use.

There is no fixed limit on the number of personal prints you may make, provided those prints remain for your personal use and are not produced for resale or other commercial purposes.

You may use a professional printing service to create those prints.

Providing the digital file to a printing service solely for the purpose of producing an authorised personal print does not constitute prohibited redistribution under this licence.

You remain responsible for ensuring that the file is not intentionally made available for unrelated use or distribution.

Gifts

You may give a physical print made from a purchased photograph to another person as a personal, non-commercial gift.

You may not give, forward, copy or otherwise transfer the purchased digital file itself to another person.

If another person wishes to receive and use the digital file, they should purchase their own licence through The Wild Reverence Shop.

Collections

Where a digital collection contains multiple photographs, this licence applies separately to each photograph included in that collection.

Purchasing a collection does not grant broader usage rights than purchasing an individual photograph unless the collection product page expressly states otherwise.

All photographs within a collection remain subject to the personal-use restrictions contained in this licence.

Copyright and Ownership

Copyright and all other applicable intellectual property rights in Wild Reverence digital products remain with their respective copyright owner or rights holder.

A purchase does not constitute an assignment, sale or transfer of copyright.

The purchase price grants only the limited rights of use expressly described in this licence.

Wild Reverence and/or the applicable rights holder retains all rights not expressly granted to you.

Commercial Use

The standard digital products sold through The Wild Reverence Shop do not include a commercial-use licence unless expressly stated otherwise on the relevant product page.

If you wish to use a photograph or other digital product for a business, publication, campaign, website, commercial social media account, advertising, product, editorial project or another commercial purpose, please contact:

Commercial use may require separate written permission and may be subject to an additional licensing fee and additional terms.

Purchasing the standard personal-use product before requesting commercial permission does not automatically grant commercial rights.

Use by Businesses and Organisations

Businesses, organisations, publications, agencies and other commercial entities may not rely on the personal-use licence for commercial or organisational use.

Please contact Wild Reverence before using a purchased photograph for such purposes.

A separate licence may be made available depending on the intended use.

Prohibited and Unlawful Use

A digital product may not be used:

• for any unlawful purpose;
• in a manner that infringes the rights of another person;
• in a deceptive or misleading manner;
• in a way that falsely suggests endorsement, sponsorship or association by Wild Reverence, Tayla Evans or another depicted or associated person;
• in defamatory material; or
• in any manner otherwise prohibited by applicable law.

People, Animals, Places and Property Depicted

Purchasing a photograph does not grant you ownership of, or separate rights relating to, any person, animal, property, artwork, trademark, location or other subject depicted in the photograph.

This licence grants rights only in relation to the use of the purchased digital product as expressly described in this document.

No additional model, property, trademark or other third-party rights should be inferred from the purchase.

Download Access

Unless otherwise stated on the relevant product page, digital products are available for a maximum of five (5) download attempts and for thirty (30) days after the download is made available.

You are encouraged to download and safely back up your purchased files during this period.

The expiry of the download period does not terminate your personal-use licence for a file that you have legitimately downloaded and retained.

In other words, you do not lose your right to personally use the photograph after thirty days. The thirty-day period applies to access to the downloadable file through The Wild Reverence Shop.

Unauthorised Use

If a digital product is used outside the scope of this licence, Wild Reverence and/or the applicable rights holder reserves the right to take reasonable steps to protect the relevant intellectual property rights.

Where appropriate, this may include requesting removal of unauthorised material, terminating permission to use the product, seeking payment for unauthorised commercial use, or pursuing other remedies available under applicable law.

Nothing in this section limits any rights or remedies available to either party under applicable law.

Refunds

The granting of this licence and any refund, replacement or remedy relating to the underlying purchase are subject to our Refund and Returns Policy and applicable South African law.

Nothing in this Digital Product Licence is intended to exclude, restrict or replace a consumer right or remedy that cannot lawfully be excluded, restricted or replaced.

Changes to This Licence

We may update this Digital Product Licence from time to time to reflect changes to our products, licensing arrangements, business practices or applicable requirements.

The latest version will be published on this page together with the updated revision date.

Any changes will not retrospectively reduce the rights already granted in respect of a completed purchase unless required by applicable law.
